The regulation is established on the basis of § 57 (1) of the Notarisation Act (RT I 2001, 93, 564)

§ 1 The notaries of the foreign countries whose certified power of attorney is equal to the Estonian notarized power of attorney

(1) The officials of the foreign country whose certified power of attorney is equal to the Estonian notarized power of attorney are the notaries of the following countries:

  1. 1)  Argentina
  2. 2)  Austria
  3. 3)  Belgium
  4. 4)  Bolivia
  5. 5)  Brazil
  6. 6)  Dominican
  7. 7)  Ecuador
  8. 8)  Guatemala
  9. 9)  Spain
  10. 10)  Holland
  11. 11)  Honduras
  12. 12)  Croatia
  13. 13)  Italy
  14. 14)  Japan
  15. 15)  Columbia
  16. 16)  Costa Rica
  17. 17)  Greece
  18. 18)  Lithuania
  19. 19)  Luxembourg
  20. 20)  Latvia
  21. 21)  Malta

211) Mauritius 22) Mexico 23) Monaco 24) Nicaragua 25) Panama 26) Paraguay 27) Peru

28) Poland
29) Portugal 30) France

(2) If in the foreign country mentioned in subsection 1 the transactions are certified and other such tasks of the notary are fulfilled by the official whose title includes no equivalent of the word “notary” in the language of the country of location, he/she is handled as the notary in the meaning of this regulation, if he/she belongs to the local member organization of the International Union of Latin Notaries.

§ 2 The notaries of other territories whose certified power of attorney is equal to the Estonian notarized power of attorney

The foreign officials whose certified power of attorney is equal to the Estonian notarized power of attorney are, in addition to the ones mentioned in section 1:
1) notary public of Department of Louisiana of the United States of America.
2)Notary of Quebec province of Canada (notaire, notary);

3) Clerk-notary of the City of London (scrivener notary); 4) Notary of Puerto Rico (notario, notary).

§ 3 The requirement for certification of the notarized power of attorney with legalization or apostille

In case of the powers of attorney certified by the officials mentioned in section 1 and 2 the legalization or apostille requirements resulting from § 56 of the Notarisation Act should be also met, if the foreign contract is not providing otherwise.

§ 4 Other officials whose certified power of attorney is equal to the Estonian notarized power of attorney

In addition to the powers of attorney certified by the notaries mentioned in sections 1 and 2 the powers of attorney certified by the authorities and institutions of the following countries are considered equal with the power of attorney certified by the Estonian notary which have the apostille attached by the institution or official having the right of certification with apostille according to the convention of cancellation of legalization requirement of the public document of the foreign country“ or which has been legalized by the institution or official having the legalization competence of the relevant country as well as the Ministry of Foreign Affairs of the Republic of Estonia:

1) United States of America, except American Samoa, United States Virgin Islands and Northern Mariana Islands;
2) Andorra
3) Australia, except Christmas Island, Cocos Islands and Norfolk Island;

4) Bulgaria
5) Georgia
6) People’s Republic of China, except Macau;
61) Hong Kong(Xianggang);
7) Ireland;
8) Israel;
9) Iceland;
10)Canada
11) Korean republic
1111) Cyprus
112) Liechtenstein
12) Republic of South Africa
13)Norway
14) Sweden
141) Republic of Singapore
15) Finland
